1. Who We Are

Socialbird AI is operated by Eventail Services, a French SASU registered in Agen, France.

By creating an account and using Socialbird AI, you agree to these Terms of Service and our Privacy Policy in full. If you don't agree, don't use the service.

2. Eligibility and Accounts

You must be at least 18 years old to use the service. If you use Socialbird AI on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

When you create an account you agree to provide accurate information, keep your login credentials secure, and notify us immediately at legal@socialbird.ai if you suspect unauthorized access to your account. You are responsible for everything that happens under your account.

3. One Brand Per Account

Socialbird AI is designed to serve one brand per account. While multiple team members may access a single account — for example, a team managing content for one personality, brand or business — the AI is calibrated to one brand voice, one strategy, and one content identity.

Using a single account to manage multiple distinct brands or identities is not supported and will produce unreliable results. If you need to manage multiple brands, contact legal@socialbird.ai to discuss appropriate solutions.

4. Free Trial, Plans and Billing

4.1 Free Trial
New accounts receive a 14-day free trial with full access to all features of the selected plan. Credits are available immediately and fully usable during the trial. Credits are not replenished mid-trial. If you exhaust your credits during the trial, no additional credits are added until your first billing cycle begins.

4.2 Subscriptions
Paid plans are billed monthly. Your first charge occurs on day 15. Subscriptions renew automatically at the end of each billing period unless you cancel before renewal. By subscribing, you authorize us (through Stripe) to charge your payment method on each renewal date.

4.3 Plan Changes
Upgrades and downgrades take effect at the start of your next billing cycle. You retain access to your current plan's features until that date.

4.4 Cancellation
You may cancel your subscription at any time from within your account settings. Cancellation takes effect at the end of your current billing period. You retain full access until that date. No partial refunds are issued for unused time.

4.5 Failed Payments
If a payment fails, your account will display a payment overlay requiring you to update your payment method. Access to Socialbird AI features will be restricted until payment is resolved. No grace period is granted. Your data is retained during this period.

4.6 Refunds
All payments are non-refundable except where required by applicable French or EU consumer law. If you believe you are entitled to a refund, contact legal@socialbird.ai within 7 days of the charge in question.

4.7 Price Changes
We may change our prices. For existing paying subscribers, a price change takes effect on the next billing period after we give you at least 30 days' notice by email. If you don't agree with the new price, you can cancel before it takes effect.

4.8 Taxes
Stated prices do not include VAT or other applicable taxes, which will be added to your invoice where required by law.

5. Credits

Credits are consumed each time the AI generates content. Allocations reset at the start of each monthly billing cycle. Unused credits do not roll over. Credits have no monetary value and cannot be transferred, sold, or redeemed for cash.

6. Your Content and Intellectual Property

6.1 You Own Your Outputs
Any content generated by Socialbird AI on your behalf belongs to you. You retain full ownership of all AI-generated content produced within your account.

6.2 Your Responsibility
Before publishing any AI-generated content, you are responsible for reviewing it for accuracy, appropriateness, and compliance with the rules of the platform you are posting to. The act of copying, adapting, or publishing AI-generated content constitutes your explicit approval of that content. Eventail Services accepts no liability for the consequences of publishing AI-generated content.

6.3 Your Input Data
By connecting your social accounts and providing brand, voice, and strategy information, you grant Eventail Services a limited license to process that data solely to operate Socialbird AI for your account. We do not use your data to train AI models.

6.4 Feedback
If you send us feedback, ideas, or suggestions about the service, we may use them without restriction or compensation to you.

6.5 Socialbird AI
All rights in the Socialbird AI platform — including its design, features, branding, and underlying technology — remain the exclusive property of Eventail Services.

7. Acceptable Use

You agree not to use Socialbird AI to:

• Violate any applicable law or third-party rights

• Generate content that violates Anthropic's usage policies, which govern our underlying AI

• Generate spam, coordinate inauthentic behavior, or violate any social platform's terms of service

• Manage multiple distinct brands or identities within a single account

• Reverse-engineer, copy, or attempt to replicate any part of the Socialbird AI platform

• Scrape, harvest, or extract data from the service through automated means

• Resell or sublicense access to the service

• Interfere with the service's normal operation or place unreasonable load on our infrastructure

• Misrepresent AI-generated content as human-authored in contexts where doing so is illegal or violates a third party's rules

We may investigate suspected violations and take action including warning, suspending, or terminating accounts without notice and without refund.

8. Third-Party Platforms

8.1 No Affiliation
Socialbird AI is an independent product. We are not affiliated with, endorsed by, or partnered with LinkedIn, X, Instagram, TikTok, Facebook, YouTube, Threads, WhatsApp, or Telegram. Platform names and logos are the trademarks of their respective owners, used solely to identify the platforms the service supports.

8.2 Your Responsibilities on Platforms
Your interactions with third-party platforms are subject to those platforms' own terms and policies. You are solely responsible for complying with them. The fact that a feature is available inside Socialbird AI does not grant you any right under any platform's terms.

8.3 Connected Accounts
If you connect a platform account to Socialbird AI, you authorize us to access and process the data needed to make that connection work. You can disconnect a connected account at any time from your account settings.

9. Copyright and Takedown Requests

If you are a creator or rights holder and believe content surfaced inside Socialbird AI infringes your rights, email legal@socialbird.ai with: your identity and contact information, identification of the content in question, and a statement of your good-faith belief that the use is unauthorized. We will action verified requests promptly.

10. Account Suspension and Termination

10.1 Suspension for Non-Payment
If payment fails and is not resolved, your account will be restricted. Your data is retained. Full access is restored once payment is resolved.

10.2 Termination for Violation
If your account is terminated for a violation of these Terms, future payments are frozen and your account is blocked. Eventail Services reserves the right to permanently delete your account and all associated data, or to restore access at our sole discretion following review.

10.3 Termination by You
You may delete your account at any time from within the app. Upon deletion, all your data is removed from our systems within 30 days, subject to retention obligations described in our Privacy Policy.

10.4 Termination by Us Without Cause
If we terminate your account without cause — for example, because we discontinue the service — we will refund any prepaid fees for the unused portion of your subscription.

11. AI Features and Outputs

The service includes AI features powered by Anthropic's Claude. When you use these features:

• You own the outputs the AI generates for you, to the maximum extent permitted by law

• AI outputs may be inaccurate, outdated, or imperfect — review every output before publishing

• The same or similar prompt may produce similar output for other users — we do not guarantee exclusivity

• We do not use your private content to train AI models — see Section 6.3 and our Privacy Policy

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EVENTAIL SERVICES DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING ANY OUTCOME RELATED TO REACH, ENGAGEMENT, FOLLOWERS, OR REVENUE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVENTAIL SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF SOCIALBIRD AI, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, DAMAGE TO REPUTATION, OR ACCOUNT SUSPENSION BY A THIRD-PARTY PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF SOCIALBIRD AI SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO EVENTAIL SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR LIABILITY THAT CANNOT BE EXCLUDED UNDER FRENCH LAW.

14. Indemnification

You agree to defend, indemnify, and hold harmless Eventail Services and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your content, your use of the service, your violation of these Terms, or your violation of any applicable law or third-party right.

15. Force Majeure

Eventail Services is not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, internet or telecommunications outages, third-party service failures (including Anthropic, Stripe, or Supabase), or government actions.

16. Changes to the Service or These Terms

We may add, change, or remove features at any time. We may update these Terms from time to time. When we make a material change, we will update the effective date and notify you by email before the change takes effect. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms.

17. Governing Law and Disputes

These Terms are governed by French law. You and Eventail Services agree to first try to resolve any dispute informally by contacting legal@socialbird.ai. If we cannot resolve a dispute informally within 60 days, any claim arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of France.

18. General

18.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Eventail Services regarding the service.

18.2 No Waiver
Our failure to enforce any provision is not a waiver of that provision or any other.

18.3 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.

18.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

18.5 Relationship
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Eventail Services.
